Judging with a Gender Perspective
(Rule 61, Chapter 1)
In 2013, the Supreme Court of Justice of the Nation (SCJN) published the first edition of the Protocol for Gender Perspective in Judging. This document was developed to address the order of the Inter-American Court of Human Rights (IACHR) in numerous cases against Mexico, linked to the severity and systematic nature of violence against women. It aims to create an analytical method to incorporate a gender perspective into the analysis of a judicial case . Thus, it first involved reflection on how to judge those cases in which gender plays a significant role in the controversy, in order to have a differentiated impact on the individuals involved, particularly women and girls.
The protocol was updated in 2019, after a consultative process was carried out that involved judicial personnel from different areas of jurisdiction, justice sectors, and federal entities. Litigants and members of civil society organisations dedicated to the defence and promotion of human rights, as well as experts from the academic field, also participated in the process.
