Guidance document for judges on consideration of torture cases

This guidance document was developed by the judges of the Supreme Court of the Kyrgyz Republic in accordance with the “Criminal Law” training course. It includes a comprehensive legal analysis of the most dangerous factors of torture, and an analysis of liability for torture in the legislation of the Kyrgyz Republic and international law. A number of theoretical provisions related to the delimitation of torture from other crimes are clarified, and improved measures to enhance the effectiveness of the conduct in question are provided.

The guidance document is recommended for law students, practicing lawyers, law enforcement officials and judges.

The document was developed as part of the project “Strengthening the engagement of judicial authorities to take concrete actions on torture prevention” with financial support from the Democracy Commission of the US Embassy in the Kyrgyz Republic.
